1. Acknowledgement

You and GRIM WORKS SL acknowledge that this Agreement is between you and GRIM WORKS SL only, not Apple. GRIM WORKS SL is solely responsible for the App and its content. This Agreement does not conflict with the Apple Media Services Terms and Conditions.

2. Scope of License

You are granted a non-transferable, non-exclusive, revocable license to use the App on any Apple-branded product that you own or control, as permitted by Apple’s Usage Rules in the Apple Media Services Terms and Conditions. This license includes use by other accounts associated with you via Family Sharing or volume purchasing.

3. Maintenance and Support

GRIM WORKS SL is solely responsible for providing maintenance and support for the App, if required by applicable law. Apple has no obligation to provide any maintenance or support services.

4. Warranty

GRIM WORKS SL is solely responsible for any express or implied warranties, to the extent not effectively disclaimed. If the App fails to conform to any warranty, you may notify Apple, and Apple may refund the purchase price (if applicable). Beyond that, Apple has no warranty obligation. All liability related to warranty falls solely to GRIM WORKS SL.

5. Product Claims

GRIM WORKS SL is responsible for addressing any claims you or a third party may have related to the App, including but not limited to:

• Product liability claims
• Claims that the App fails to comply with legal or regulatory requirements
• Claims arising under consumer protection or privacy laws

6. Intellectual Property Rights

If a third party claims that the App, or your use of the App, infringes their intellectual property rights, GRIM WORKS SL is solely responsible for handling the investigation, defense, settlement, and resolution of that claim.

7. Legal Compliance

You represent and warrant that:

• You are not located in a country subject to a U.S. Government embargo
• You are not listed on any U.S. Government list of prohibited or restricted parties

9. Third-Party Terms

You agree to comply with all applicable third-party terms of service when using the App. For example, if using the App on a cellular network, you must not violate your wireless data service agreement.

10. Third-Party Beneficiary

You and GRIM WORKS SL agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

11. AI Assistant & Health Disclaimer

The App includes an AI-powered assistant ("Siena") designed to provide general wellness and cycle-related information. By using this feature, you acknowledge and agree that:

1. Not Medical Advice: Siena is an Artificial Intelligence, not a human doctor or healthcare professional. The information provided is for educational and informational purposes only and DOES NOT constitute medical advice, diagnosis, or treatment.
2. Consult a Professional: Never disregard professional medical advice or delay in seeking it because of something you have read in this App. If you have a medical emergency, call your doctor or emergency services immediately.
3. Accuracy: While we strive for accuracy, AI technology may occasionally generate incorrect, biased, or misleading information ("hallucinations"). GRIM WORKS SL does not warrant the accuracy, completeness, or usefulness of any AI-generated responses.
4. Health Data Processing: You consent to the processing of the health data you voluntarily share in the chat by our AI providers (e.g., Google Gemini) for the sole purpose of generating responses.

12. Marketing Analytics and Tracking Consent

To better understand how users discover and interact with our App, we may collect limited, non-identifiable analytics data related to:

• App installations that originate from advertising campaigns
• Progress through the initial setup process
• Subscription activity

This data may be shared with platforms such as Meta (Facebook/Instagram), TikTok, or Apple’s SKAdNetwork to measure ad performance and optimize future campaigns. In accordance with Apple’s App Tracking Transparency (ATT) framework, we request your permission before using your device’s advertising identifier (IDFA) for these purposes.

You can allow or deny tracking when prompted. Opting out will not affect your ability to use the App or your subscription access. You may also change your consent preferences anytime in your iOS Settings: Settings > Privacy & Security > Tracking
